Under Arizona law, HOA rules and CC&Rs do not carry the same authority, and understanding the difference matters if you receive a violation notice. CC&Rs are recorded documents that run with the land and function as a contract between the HOA and each homeowner. HOA rules, by contrast, are typically adopted by the board and can often be modified without a full membership vote.
In this video, I explain how CC&Rs create binding use restrictions and grant enforcement authority to the association. I also break down how boards create additional rules, why those rules must stem directly from authority granted in the CC&Rs, and what homeowners should look for if a violation notice does not cite a specific provision.
If your HOA is enforcing a rule, the first step is to review the recorded CC&Rs and confirm that the board had authority to adopt and enforce that rule in the first place.
